    In the e-commerce annexe of the leaked TiSA negotiations, article 6/1 states:

    No Party may require the transfer of, or access to, source code of software owned by a person of another Party, as a condition of providing services related to such software in its territory.
    This effectively bans any enforcement of open source software by governments. Meaning that governments can't obstruct the use of proprietary software in government institutions. And it also effectively prevents the governments to require source code of proprietary software (ie. Windows, Microsoft Office) for security reasons with a non-disclosure agreement.

    It seems Japan supports this proposal while Colombia opposes.
