    Following the proposed patches this week to adjust the Linux kernel's module loader to treat the TUXEDO Computers drivers as proprietary due to being GPLv3 licensed rather than GPLv2 to jive with the rest of the upstream kernel code, some of the TUXEDO drivers have now been re-licensed...

        The kernel itself is GPLv2-only. If one piece of code says "GPLv2 only" and the other says "GPLv3 or later", copyright law takes issue with that.

              Correct me if I am wrong, but, even if he wanted, Linus could not change Linux to GPLv3, or GPLv2+ (which would make it compatible with GPLv3 code), because many people contributed without any kind of CLA, right ?
