A bad coding style, they will not fix this:

They should remove that line, every error causes boot flashing. The user that configures kernel knows if the retpoline fix is needed or not.

Obviously in your case the user has no idea what he's doing. If you did have an in-order CPU that didn't need mitigations that message would not have been shown.
