So how did they circumvent the ZFS licence?

If they're expecting people to buy this, they're in for disappointment.

The same way everyone else (FreeBSD, NetBSD, certain other Linux distros) circumvents it: you build it as a kernel module.

            About ZBOSS Linux

            Hi,

The ZFS kernel module in ZBOSS Linux is NOT from ZFS on Linux project. This is our own port of ZFS that is much stable and high performing.
The Linux and the ZFS is free to use with unlimited storage. Only for the advanced features iSCSI, SAN, VTL, replication, and high-availability we charge very affordable license fee.

            Thanks
            ZettaByte Open Storage Server team.

What license is your ZFS module?

Since the Linux kernel is GPLv2, it forbids linking and loading proprietary software modules?

This cannot be true, otherwise the nViDiA and FGLRX modules would be illegal.
