Hey, at least FLAC can be completely decoded, unlike some original tracks (DTS-HD MA) and can be encoded with FOSS software (unlike TrueHD). So, seems like logical choice, no?
As for 10-bit usage years before it became trend in the industry - also logical, as this choice visibly reduce banding in comparison with 8-bit encoding.

So, seems like release groups guilty in using best available tech. for the task, in hope that industry will catch up some day, which actually happen in form of 10-bit HEVC.
